These Terms set out the relationship between you and 2 ZOMBIE GAMES LTD ("us" or "we") regarding your use of our Services. Your use of our Services is also subject to our Privacy Policy.
Please read these Terms. If you do not understand these Terms, or do not accept any part of them, then you should not use or purchase the Services. By installing, using or accessing our Services you accept our Terms and Privacy Policy.
You can access these Terms at any time at 2zombie.com. We reserve the right, at our sole discretion, to change, modify, add or remove portions of our Terms and Privacy Policy by posting the amended terms at 2zombie.com. Your continued use of our Services confirms your acceptance of the updated Terms or Privacy Policy.
The materials contained in our Services are protected by applicable copyright and trade mark law.
Use License
Subject to these Terms, we grant you a non-exclusive, non-transferrable licence to use our Services for your own non-commercial entertainment purposes. You agree not to use our Services for any other purpose.
The licence commences on the date that you accept these Terms and install or otherwise use our Services.
The licence ends on the earlier of your disposal of the Services or our termination of the licence in accordance with these Terms.
This is the grant of a license, not a transfer of title, and under this license you may not:
- Modify or copy the materials from our Services;
- Use the materials for any commercial purpose, or for any public display (commercial or non-commercial);
- Attempt to decompile or reverse engineer any software contained in our Services;
- Remove any copyright or other proprietary notations from the materials; or
- Transfer the materials to another person or "mirror" the materials on any other server.
This license shall automatically terminate if you violate any of these restrictions and may be terminated by us at any time. Upon terminating your use of these materials or upon the termination of this license, you must destroy any downloaded materials in your possession whether in electronic or printed format.
Intellectual Property
You agree that all Intellectual Property relating to our Services is owned by or licenced by us. Our Services are being licensed to you and you understand that no title or ownership in our Services is being transferred or assigned and these Terms are not a sale of any rights in our Services.
Our Services may allow you to create User Content. To the extent that any User Content created by you gives rise to any Intellectual Property rights, you will retain ownership of these, and you grant us a worldwide, perpetual, irrevocable, royalty-free, fee-free, fully transferable and sub-licensable licence to use, exploit or modify your User Content in any way and for any purpose, without compensation to you. You further agree not to enforce, and otherwise waive to the fullest extent legally possible, any moral rights that you may have now or in the future in respect of your User Content.
Virtual Items
Our Services may include Virtual Items. These items can be earned through use of our Services or "purchased" with or by the exchange of other Virtual Items or with legal currency or Provider Credits.
You agree that Virtual Items only exist within our Services and can never be exchanged for real money, real goods or real services from us or anyone else. You do not own Virtual Items but instead you purchase a limited personal revocable licence to use them. Any balance of Virtual Items does not reflect any stored value.
We reserve the right to control, regulate, change or remove any Virtual Items without any liability to you.
You are not entitled to bring any Claims in respect of, and do not suffer, any Loss as a result of any "loss" of or "damage" to your Virtual Items. To the full extent permitted by law, we will not be liable to compensate you in respect of any matter whatsoever related to the Virtual Items, including but not limited to any Loss you allege to have suffered or any Claims you allege to be entitled to bring.
Virtual Items are associated with your account on the relevant platform (such as Steam, Epic Games, or others) through which you access our Services. If the platform suspends or terminates your access, you may lose any Virtual Items associated with that account and we will not compensate you for this loss or make any refund to you.
Warranty
OUR SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS FOR YOUR USE. YOU UNDERSTAND THAT OUR SERVICES CANNOT BE GUARANTEED TO BE ERROR FREE AND THE EXISTENCE OF ANY ERRORS WILL NOT BE A BREACH OF THESE TERMS.
We make no warranties, expressed or implied, and hereby disclaim and negate all other warranties, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights. Further, we do not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on our website or otherwise relating to such materials or on any sites linked to this site.
While we strive to protect your information, we cannot guarantee the security of any information you transmit to us. Accordingly, any information which you transmit to us is transmitted at your own risk. However, once we receive your transmission, we will take reasonable steps to preserve the security of it.
You must take your own precautions to ensure your access to our Services does not expose you to the risk of viruses, malicious computer code or other forms of interference which may damage your Devices. We do not accept responsibility for any interference or damage to your Devices which arises in connection with your use of our Services.
Limitations
In no event shall we or our suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use our Services, even if we or our authorized representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.
Revisions and Errata
The materials appearing on our Services could include technical, typographical, or photographic errors. We do not warrant that any of the materials on our Services are accurate, complete, or current. We may make changes to the materials contained on our Services at any time without notice. We do not, however, make any commitment to update the materials.
Third-Party Platforms
Some of our Services are made available through third-party platforms such as Steam, Epic Games Store, PlayStation Network, Microsoft Store, Apple App Store, and Google Play (each a "Platform"). When you access or purchase our Services through a Platform, your use of that Platform is governed by the Platform's own terms of service and privacy policy, which take precedence over these Terms in relation to your Platform account, payments, and any Platform-specific functionality. We are not responsible for the policies, practices, or actions of any Platform.
Any purchases made through a Platform are processed by that Platform and subject to its refund and billing policies. Please refer to the relevant Platform's terms for details.
Age Restrictions
Our Services include games with different age ratings. Each game carries an age rating assigned by the relevant rating authority (such as PEGI, ESRB, or the applicable platform rating system). You must be of the minimum age required by the rating of the specific game you are accessing.
If you are under the applicable minimum age, you may only use our Services with the involvement and consent of a parent or legal guardian. By allowing a minor to use our Services, the parent or guardian agrees to these Terms on the minor's behalf and accepts responsibility for the minor's use of the Services.
We do not knowingly collect personal data from children under the age of 16 without verifiable parental consent. If you believe a child has provided us with personal data without appropriate consent, please contact us at support@2zombie.com.
Governing Law
Any claim relating to our Services shall be governed by the laws of the Republic of Armenia without regard to its conflict of law provisions.
